Transfer of property (S.5)

Act by which a living person conveys property, in present or future, to another living person (inter vivos).

Immovable property (S.3)

Excludes standing timber, growing crops, grass; includes land & benefits arising out of land.

Notice (S.3)

Actual or constructive (wilful abstention, gross negligence, registration, possession, notice to agent).

What cannot be transferred (S.6)

Spes successionis (a), right of re-entry (b), easement (c), restricted interest (d), mere right to sue (e), public office/pension (f-g).

Restraint on alienation (S.10)

Absolute restraint VOID; partial restraint valid (Rosher v. Rosher).

Rule against perpetuity (S.14)

Vesting cannot be postponed beyond lives in being + minority (18 yrs). Exception: public benefit (S.18).
